Statement on a Child Welfare League of America Report on DCF

Yesterday I released the following statement regarding a Child Welfare League of America (CWLA) report on the Department of Children and Families (DCF):

“The long awaited report by the Child Welfare League of America offers many needed recommendations that the Department of Children and Families and the legislature should swiftly institute.  It’s important to have sufficient funding, but it needs to be accompanied with meaningful reforms that won't allow one person or a hundred people at DCF to fail to act in the best interests of the children and families in the care of the agency.

The legislature and the Governor have little time to react to the report before the legislative session ends in July, but we need to ensure that the best interest of the state’s most vulnerable children are met.  Too much time has passed already.”

Statement on the Resignation of Commissioner Roche

Today I released the following statement regarding the resignation of Department of Children and Families Commissioner Olga Roche:

“The resignation of Commissioner Roche is an important and necessary step in reforming the Department of Children and Families, but it’s not the only step that needs to be taken.

DCF has systemic failures, and they demand sweeping reform to protect some of our state's most vulnerable children and families. Responsible caseloads, accountability at every level, a focus on the best interest of the child, and timely actions need to be part of the fabric of this agency.

For the legislature and the Governor to leave these reforms undone in the wake of Roche's departure would be a serious mistake and a disservice to our state.”

An Interesting Editorial

In today’s Eagle Tribune, the newspaper offers its perspective regarding the ongoing issues that continue to hamper the Department of Children and Families.  The newspaper correctly cites that additional taxpayer money is not the only solution to correct the systemic issues that currently run deep within the agency.

Statement Regarding a DCF Audit by Auditor Bump

Today I released the following statement regarding a two-year audit of the Department of Children and Families by Auditor Suzanne Bump:

“Today’s audit report issued by Auditor Bump reconfirms the risks posed to vulnerable children because of deficiencies and systematic problems at the Department of Children and Families.  Now, more than ever, it is clear that reforming this agency needs to be a priority for the Legislature and the Administration, and the job needs to be done in a timely and effective way.”

Statement on a Report Released Today by the Child Welfare League

Today I released the following statement regarding a report issued by the Child Welfare League, who has been hired to review the Massachusetts Department of Children and Families:

“Today’s progress report from the Child Welfare League makes it clear that we have substantial work to do to reform the Department of Children and Families, and to ensure that the health, safety, and well-being of vulnerable children are not jeopardized by this agency.

The report confirms the need for responsible caseloads, more modern technology and better medical screening protocols, and woven through all of these issues is greater accountability at all levels.

In addition, the report also points to the immediate need to confront the problem of granting waivers for children to be placed in homes with those convicted of felonies and other crimes.  There is a clear contrast between the situation we have today and the system we need to have, which bans some placements outright and puts in place monitoring and accountability to protect the children in others.

Changing from a system that grants waivers to one that requires approval, as expressed in the report, reflects the intent of the amendment offered by Senate Republicans and approved by the Senate on February 13th, to require that the safety and necessity of these placements be certified in writing before they are allowed.”

Statement on an Independent Investigation of DCF

Today I released the following statement regarding an independent investigation of the Massachusetts Department of Children and Families conducted by the Child Welfare League of America:

“A thorough and unbiased third-party investigation is necessary and important to correcting problems at DCF, and my hope is that the Child Welfare League of America can provide such an investigation.  At a minimum it must be as comprehensive as possible, be able to go where the facts take it, seek and use information from many sources, and be produced through a transparent, accountable process that is supported by sufficient resources to get the job done.

The facts surrounding the case of Jeremiah Oliver, and those that have surfaced as a result of that case, are deeply disturbing and they demand that we all work to address this situation in an effective manner.  I appreciate today’s update from Governor Patrick, and hope that he will continue to openly report on the progress of CWLA’s efforts.”

Senate Republican Caucus Press Release Regarding DCF

Today the Senate Republican Caucus distributed the following press release regarding a letter sent by the caucus to Auditor Suzanne Bump and Inspector General Glenn Cunha, urging them to begin an independent investigation regarding the services provided by the Department of Children and Families:

Senate Republican Caucus Seeks Independent Investigation of DCF Services

Immediate Review of All Cases Warranted for the Welfare of Children

Boston- Responding to recent reports of the disappearance of a missing 5-year-old Fitchburg child, the Senate Republican Caucus, led by Senator Don Humason (R-Westfield), who is the republican member serving on the Joint Committee on Children, Families and Persons with Disabilities, is calling for an independent investigation by Auditor Suzanne Bump and/or Inspector General Glenn Cunha into the failures of the Department of Children and Families (DCF) regarding the disappearance of Jeremiah Oliver.

Since September 2011, Jeremiah Oliver and his family have been receiving services from DCF, however, the supervisor and social worker assigned to the family failed to conduct monthly, mandated household checks.  Sadly, Jeremiah Oliver was last seen on September 14th, and his whereabouts remain unknown.

In the December 20th letter to Auditor Bump and Inspector General Cunha, the Senate Republican Caucus wrote “Increasingly, as our understanding of the department’s failure to carry out its mandate expands, there are further growing concerns for all other children in the DCF system.”

On Thursday, December 19th, Commissioner Olga Roche of DCF announced that the department will conduct its own internal review into as many as 40,000 cases, however, citing the need for an independent review, the caucus wrote, “We request and encourage a full review and examination independently or in concert (by the auditor and the inspector general), of the DCF’s practices and procedures so that we can prevent any other similar abuse or problem from occurring.”

The Senate Republican Caucus requests that the investigation include:

·         collecting as much information as possible to assess the risk and safety issues for children in the system;

·         determining how many children have not had direct, monthly contact with a DCF case worker;

·         determining the adequacy of the 110 CMR 6.00 and other pertinent regulations relative to case review procedures for children in foster care and non-foster care settings;

·         determining the adherence to standards in comprehensive assessments and family service plans;

·         determining the Department’s adherence to procedures established under 110 CMR 13.00 for the Case Investigation Unit;

·         assessing the number of service plans initiated as a result of a 51A child abuse or neglect filing or court order;

·         collecting information as to the standard number of cases assigned to social workers and the average number of children assigned to social workers;

·         determining if there has been public access to appropriately redacted reports of the Department's Case Investigation Unit;

·         determining if case management activities and other services provided to children and families were adequate and appropriately adhered with DCF policies and regulations; 

·         referring any relevant finding of a criminal nature to the Attorney General;

·         providing recommendations that may improve the DCF’s policy, regulations, training, or contracted services; and

·         providing procedural recommendations, that when adhered to, will require that DCF acts in a manner that is accountable and open to oversight.

“The nature and scope of these developing circumstances demand independent investigations.  Only through well-developed inquiry can we determine how to best help the staff and management of DCF to protect the lives of children,” the Caucus wrote.
